On April 5, 2022 Honolulu’s Mayer signed Bill 38 into effect, banning all commercial activity on windward beaches from Waimanalo to Makapu’u of Hawaii. Bill 38 Hawaii photography affects far more than just the photography industry, but certainly makes sweeping changes to where families can do their photos. This ban includes several popular photography locations including:
- Makapu’u Lighthouse
- Makapu’u Beach
- Waimanalo Beach Park

Hawaii is well-known for its beautiful beaches, and they are a major attraction for tourists and locals alike. Custom family, engagement and couples photography is a popular souvenir and for good reason.
However, the state has faced issues with overcrowding and commercial activity on some of its beaches, particularly on the windward side of the islands. In response to these concerns, the state has implemented a ban on commercial activity on windward beaches to protect the natural environment and ensure public safety.
What you wear matters
I tried to avoid it for years. But the fact is it matters.
It may not make or break the anything, but planning out the details of undergarments, colors and movement will go a long way to a great experience and even better photos!

Hi I’m Alison, your chaos coordinator, family photographer in O’ahu Hawai’i.
As the ringleader of my own 4 boy circus, I know how hard getting family photos can be.
If I could dress your kids and literally hang your family photos on your walls, I would.
…but I can’t, so I do just about everything else in between.
That’s why I take the time to hold your hand from start to finish.
Because what good are family photos if your kids never see them?
Background on Windward Beaches in Hawaii
The windward side of the islands in Hawaii refers to the side that faces the prevailing winds, and it is known for its lush vegetation, mountainous terrain, and some of the most beautiful beaches in the world. These beaches attract a large number of visitors, but their popularity has led to issues such as overcrowding, damage to the natural environment, and safety concerns.
The Ban on Commercial Activity on Windward Beaches – Bill 38 Hawaii Photography
In response to these concerns, the State of Hawaii has implemented a ban on commercial activity on windward beaches. This ban prohibits any commercial activity, including vendors, equipment rentals, and commercial tours, from operating on these beaches. The ban is intended to protect the natural environment and ensure public safety by reducing the number of people and vehicles on the beaches.
What is Illegal in Hawaii Based on this Ban?
Any business or commercial enterprise including but not limited to:
- Family photography
- Wedding photography
- Branding photography
- Engagement photography
- Couples photography
- So much more
Impact of the Bill 38 on Hawaii Photography
The ban on commercial activity on windward beaches has had a significant impact on the state’s tourism industry, but it has also had positive effects on the environment and local communities. The ban has helped to reduce overcrowding on these beaches, which has led to a decrease in litter, erosion, and damage to fragile ecosystems. It has also created a more peaceful and enjoyable experience for visitors and locals who come to these beaches to relax and connect with nature.
The ban has had a positive impact on local businesses that offer eco-tourism experiences and promote sustainable practices. These businesses are able to operate without competing with large commercial operators that have a negative impact on the environment and local communities.
Overall, Hawaii’s ban on commercial activity on windward beaches is an important step towards protecting the state’s natural environment and ensuring the safety and enjoyment of its visitors and residents. It serves as an example for other states and countries to follow in their efforts to balance economic development with environmental conservation.HEY!
